This is an ambitious book trying to cover in a systematic and
comprehensive manner what is normally include under the term of European
Economic Law. The French expression "droit matériel" is in effect
broader that simply Economic law and includes all that is not covered by the
expression "droit institutionelle" (relating to the institutional,
judicial and decision-making rules of the EC), and the book Here is a book
which has left me with mixed feelings. It has overcome my usual initial
resistance to dogmatic works with a well conceived and original structure,
supporting an approach which is useful in its detailed coverage of EC
economic law and in its re-organisation in a systematic and clear manner of
the rules and principles which govern this area of the law. Thus, it offers
us the best that dogmatic approaches have to offer (and it´s not little) and
does it in an intelligent and original way which also gives us some glances
at the surrounding landscape of the dogmatic picture. But if the
macro-analysis is clearly positive, I was disappointed at some parts of the
micro-level, where I found myself, at points, clearly surprised by the
descriptive analysis and restatements of the law made by the author (which,
curiously, is normally one of the strong points of dogmatic approaches). Some
examples: Keck, de facto discr… purely internal situation.
